By submitting this order online, via fax or email, customer understands and agrees that they are hiring the services of The Collection Auto Transport LLC, a Federally licensed transportation brokerage (MC#: 706264), to arrange the shipment of their vehicle(s) with a Federally licensed and insured Contract Carrier, hereinafter referred to as Carrier. They further have read, understand and will abide by the following terms and conditions. The Collection Auto Transport holds the right to charge the scheduling fee. The Scheduling fee will be disclosed in the shipping order invoice. Customer may pay scheduling fee with a credit card, check by phone or simply faxing a signed check of the dollar amount owed, to 877-259-0064. Faxing a signed check authorizes The Collection Auto Transport to institute a check draft on the client’s checking account. If vehicle contracted for pick up as a running unit and then became inoperable when carrier arrives to load vehicle, an inoperable fee of $175.00 will be added per vehicle due upon delivery. It is understood and agreed that if assigned carrier attempts to pick up vehicle and the vehicle cannot be released or is not available a "dry run" fee of $100.00 will be charged. All cancellations must be advised before vehicle has been dispatched. Notice of cancellation must be emailed only to info@thecollectionautotransport.com. If order is cancelled after carrier attempted to pick - up vehicle deposit will be non-refundable. Customer agrees and understands that their vehicle(s) must be free of contents as neither The Collection Auto Transport, nor Carrier is licensed to handle the transportation of Household Goods. Damage to, loss of or fines levied to Carrier resulting from any unauthorized contents present in the vehicle during shipment are the sole responsibility of the Customer. An administration fee of $90.00 per vehicle will be applied to all cancellations requested by the customer, prior to the 10days after the first available pick up. Due to changing and unpredictable market conditions, seasonal weather, traffic, mechanical difficulties and fluctuating gas prices, rates can increase or decrease after an order has been placed, in such case customer will be notified. Customer is fully aware of such possibility. If customer does not pay the new rate which leads to a cancellation, an administration fee of $90.00 will be applied to refund per vehicle. Customer may never hold The Collection Auto Transport liable for expenses incurred as the result of any delays, including, but not limited to, any car rental fees incurred by Customer. It is strongly recommended that the Customer maintain reasonable contact with the Carrier and/or The Collection Auto Transport to stay up to date on any schedule changes. Customer understands and agrees The Collection Auto Transport will be given 10 days after the estimated date of pick-up to have vehicle picked up or customer will be presented with alternative carrier option which may adjust the total tariff based on supply/demand industry standards or a full refund of scheduling fee. Tariffs that are to be paid in full upfront will be charged 5% of the total amount. All vehicles to be delivered with a balance due must be paid upon delivery by cash or certified funds only (us funds). For all port related orders HI, PR, and AK, The Collection Auto Transport is not responsible for any delays. Customer is responsible in tracking the vehicle availability and any possible storage fees accrued. Customer should under no circumstances release a vehicle to a Carrier without an inspection report. This contract is subject to all of the terms and conditions of the Carrier’s straight bill of lading and any liability exclusions therein. Carrier and Customer, or Customer’s agent, are both required to verify and sign the initial inspection report. Failure to do so could result in the Customer’s inability to process a damage claim. Carrier assumes responsibility for any damage not noted on the initial vehicle inspection report from that point, and throughout the transportation period, until the vehicle(s) is/are delivered at the agreed destination. The Collection Auto Transport has no responsibility or liability for any damage to the vehicle(s) during transport or at any other time. Failure to note any damage on the final inspection report releases the Carrier of liability and could result in the inability to process a damage claim. Customer may never hold The Collection Auto Transport liable for damages to vehicle(s) and/or any contents. All customers to whom service was rendered will be subject to financial collections if any payment is owed to The Collection Auto Transport. The Collection Auto Transport has the right to refuse any order. Customer understands and agrees any refunds owed can take 7-15 business days. This agreement shall be governed by and construed in accordance with the laws of the state of Florida. The parties further agree that any legal action arising out of this Agreement shall be filed in a court of jurisdiction within Miami Dade, Florida and that The Collection Auto Transport liability is limited to the amount of The Collection Auto Transport service fee only. Customer hereby submits to the jurisdiction of such courts and waives any right to jurisdiction in any other location. These documents supersede any and all verbal or written communications. Customer understands The Collection Auto Transport will only refund the scheduling fee under the circumstances that we are unable to render services after the allotted 10 day time frame from the first available pick up date.
